Access to and Use of the Site imply acceptance, without reservation, of the following terms and conditions:


On the Site DENIS PERRET proposes information, organised by themes, concerning the DENIS PERRET wine merchant company, the Products available for purchase through the Site, and information about the wine-growing region, producers and wines of Burgundy.

The Site is also an e-commerce website that allows Users to order and pay online for Products, subject to acceptance of the General Terms and Conditions of Sale.

Should Users have a question regarding the activities or the Products offered for sale by DENIS PERRET, they are invited to contact DENIS PERRET via the contact details listed in article 6-1 of these Terms and Conditions.


Access to the Site is free, and provided continuously and permanently, except in cases of force majeure or events beyond the control of DENIS PERRET, and except in the case of possible breakdowns or the technical, maintenance and updating operations necessary to the proper operation of the Site.
In order to ensure a high-quality of service, DENIS PERRET also reserves the right to periods of maintenance, updating or technical operations, which may result in interruptions in access to the Site.
Furthermore, because of the very nature of the Internet, DENIS PERRET cannot guarantee 24/7 operation of the Site.


3.1 On the Site, DENIS PERRET strives to offer Users the most reliable and highest quality information.
DENIS PERRET does not however guarantee the accuracy, timeliness or completeness of the information on the Site, nor the compliance of said information with the use that Users may want to make thereof.
Accordingly, Users agree to use this information under their exclusive responsibility.
DENIS PERRET cannot therefore be held liable for any direct or indirect damages suffered by the Users or by third parties who use this information as their source, more generally by browsing and using the Site.

3.2 DENIS PERRET does not monitor sites linked to the Site via hyperlinks, and accepts no liability for these sites and the content therein.


4.1 All data of any kind on the Site, in particular text, graphics, logos, icons, images, photographs, audio or video clips, trademarks, software and characteristics of the site, are de facto protected by copyright, trademark rights and all other intellectual property rights, and belong to DENIS PERRET or to third parties having authorised DENIS PERRET to exploit them.
DENIS PERRET, in its capacity as publisher of the Site, grants to the User a private non-collective and non-exclusive usage right to said data.
The Customer undertakes under these conditions not to reproduce, summarise, modify, alter or redistribute without the express prior authorisation of the publisher, any text, title, application, software, logo, image, graphics chart, trademark, information or illustration for any purpose other than strictly private use, which precludes all representation for commercial purposes or mass redistribution.

4.2 Creating a hyperlink from a website to the Site shall require the express consent of DENIS PERRET.


In accordance with French Law No. 78-17 of 6 January 1978 on data processing, data files and individual liberties, and the decision of the CNIL (Commission Nationale Informatique et Liberté - the French Data Protection Authority) of 10 July 2006 replacing the requirement to declare websites by the procedure of declaring the processes associated with said site, DENIS PERRET has declared its customer/prospect file to the CNIL.
In accordance with the provisions of the law of January 6, 1978, Customers have the right to access data relating to them, and also the right to modify, correct or delete the aforementioned data.
To exercise this right, all they need to do is to send a letter or e-mail to the contact address listed in article 6.1 of the Legal Notice hereof.
Personal data about the Users, collected through the forms, and all future information, are intended only for the exclusive use of DENIS PERRET, as part of the implementation of services offered to Users on the Site, and shall not be communicated or transferred to third parties, other than technical service providers responsible for managing the Site, who are required to respect the confidentiality of the information and to use it only for the specific operations which they must carry out.
User data shall also be used to customize and enhance communication with them, in particular in the newsletters to which they may have subscribed.

6.2 These terms and conditions represent all the obligations of DENIS PERRET and of the User.
DENIS PERRET reserves the right to unilaterally change the Terms and Conditions hereof.
The new provisions will govern from then on all relations between the parties, and only the new version shall have probative force between them; the terms and conditions applicable are always those accessible on-line on the Site.
The User is therefore advised to regularly refer to the latest version of the Legal Notice permanently available by clicking on the "Legal Notice" link of the Site.

6.3 Should any provision of these Terms and Conditions be considered null by virtue of a current or future legal or regulatory provision, or of a legal decision having the authority of a final decision and issued by a competent court or body, this provision of the contract shall be deemed not written and all other provisions hereof shall remain in full force and effect between the parties.

6.4 These Terms and Conditions are governed by French law, both for the substantive and formative rules.
Any dispute arising from the execution or interpretation of the provisions of this contract requires the parties to come together and to try and find an amicable solution to their dispute, before applying to the competent court.

In the event of failure, only the French courts shall be competent to rule on this dispute.
